Section 72 of the Land Drainage Act of 1991 defines Land Drainage as including "defence against water (including sea water) irrigation, other than spray irrigtion and warping". Not only are there a plethora of Acts of Parliament, Regulations & Guidance, they often overlap and sometimes conflict. Consequently, the law is not very clear and many poeple are unaware of its existence. Sometimes STATUTE law is used and at other times, COMMON law is the basis of court decisions.
Aims & Objectives:
The course is designed to help unravel some of the confusing aspects of the law relating to Land Drainage and explore its position in relation to other legislation.
Session 1 - Land Drainage - Setting the Scene
Session 2 - Land Drainage - Legislation Summary - including the impact of the Flood and Water Management Act 2010 on Land Drainage law
Session 3 - Highway law relating to Surface Run-off
Throughout the course, examples of situations relating to land drainage will be discussed, including those caused by development.
The course relies heavily on reference to case law.
As mentioned above, throughout the course, examples of drainage issues will be posed for delegates to discuss and suggest how such situations could be tackled. Relevant case law relating to many of these situations will be provided.
For example:1. Illegal connections 2. Mud laden water discharged on to a highway 3. Gravel on a highway left by water discharged on to the highway 4. Flooding caused by an undersized culvert 5. Illegal culverting 6. Land ownership issues 7. Highway drainage issues adjacent to a railway line 8. Flooding problems after a motorway interrupted the natural drainage pattern 9. Hedge and ditch situations 10. Highway Authorities and Public Utilities
Mode of Delivery:
A series of PowerPoint presentations will be interspersed with group/individual exercises and relevant case law, together with ample opportunity for discussion and for delegates to share their experience.
