IChemE Forms of Contract – Introduction

Overview:

This one-day course is suitable for people of all grades and professions who do not have a working knowledge of the IChemE Books and who want to find out about the intention and philosophy of each Book and how they inter-relate.

Aims & Objectives:

The course will enable people attending to adopt the correct Book for various procurement routes and contracting strategies.

Course Outline:

The course will cover a general understanding of:

  • The formation and composition of contracts entered into
  • The roles and responsibilities of all parties to, and named in, the Books
  • Commencement, progress, delays, suspension and termination
  • Payment regimes
  • Testing requirements
  • Variations, claims and dispute resolution options
  • Insurances, bonds and guarantees

Mode of Delivery:

The mode of delivery is interactive and everyone will have the opportunity to ask questions.

The course will use the Red Book – for lump sum contracts - as the ‘base’ Book. References will be made to the other contracts, all of them the fourth edition, 2013:

  • Reimbursable – the Green Book
  • Target Cost – the Burgundy Book
  • Minor Works – the Orange Book
  • Subcontracts – the Yellow Book
  • Subcontract for Civil Engineering Works – the Brown Book

A brief reference will be made to the international contracts

Pre-Course Requirements:

Participants would be at a disadvantage without a copy of the Red Book with them, as it is a useful template for referring to differences from the other Books. It will also be the basis for some discussions.
